By activating a SiamEPOS account or continuing to use the service, you confirm that you have read and agree to these Terms. If you are signing up on behalf of a business, you confirm you have authority to bind that business.

1. The Service

SiamEPOS is a cloud-based restaurant and hospitality management platform operated by Korakot Kongponsrisiri, trading as SiamEPOS ("SiamEPOS", "we", "us", "our"). The service includes, depending on your plan:

Feature availability depends on your subscription plan. We reserve the right to add, modify, or discontinue features with reasonable notice.

2. Subscription & Payment

SiamEPOS is offered on a monthly subscription basis. All prices are in pounds sterling (GBP) and are exclusive of VAT where applicable.

No hidden fees. SiamEPOS charges a flat monthly subscription. We take £0 commission on reservations and 0% on takeaway orders processed through our widgets. The only fees are your subscription and, where you choose to accept card payments, the card processor's standard rates (charged by Stripe directly to you).

3. Free Trial

We may offer a free trial period at our discretion. During a free trial you have access to the features of the plan being trialled. At the end of the trial your account will either convert to a paid subscription (if you have provided payment details) or be deactivated. We reserve the right to modify or end free trial offers at any time.

4. Cancellation & Refunds

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period — you will not be charged again after that date and you retain full access until then.

We do not offer partial refunds for unused days in a billing period. If you believe a charge was made in error, contact us within 14 days at info@siamepos.co.uk and we will investigate promptly.

To cancel, contact us via email or WhatsApp. We do not require you to jump through hoops — a simple message is enough.

5. Acceptable Use

You agree to use SiamEPOS only for lawful business purposes in connection with your restaurant or hospitality operation. You must not:

Breach of acceptable use may result in immediate suspension or termination of your account.

6. Your Data & GDPR

You own your data. All restaurant data, customer records, menu items, and transaction history you create within SiamEPOS remain yours. We process that data on your behalf as a data processor under UK GDPR.

7. Third-Party Services

SiamEPOS integrates with third-party services to deliver the platform. Your use of SiamEPOS constitutes acceptance of these providers' terms where relevant:

We are not liable for any outage, data loss, or other failure of these third-party services, though we will take reasonable steps to mitigate the impact on you.

8. Allergen Compliance Tools

SiamEPOS includes tools to help you manage the 14 UK-regulated allergens as required by Natasha's Law (Food Information (Amendment) (England) Regulations 2019) and equivalent UK legislation.

Important: SiamEPOS allergen tools are an aid to compliance — they do not constitute legal advice or guarantee compliance with food labelling law. You remain solely responsible for the accuracy of allergen information displayed to your customers, for maintaining correct recipe records, and for any legal obligations under food safety legislation. Always verify allergen data with your kitchen team and consult a food safety professional if in doubt.

We will not be liable for any regulatory penalty, customer injury, or loss arising from inaccurate allergen information entered into the system or displayed to customers.

9. Uptime & Support

We aim to maintain high availability of the SiamEPOS cloud service but we do not guarantee uninterrupted access. Planned maintenance will be communicated in advance where possible. The SiamEPOS Pro desktop application includes offline capability so your restaurant can continue to operate during internet outages.

Support is provided via email (info@siamepos.co.uk) and WhatsApp in both English and Thai during UK business hours (Monday–Friday, 9 am–6 pm GMT/BST). We aim to respond to all queries within one business day.

10. Intellectual Property

SiamEPOS, its software, branding, design, and all associated content are the intellectual property of Korakot Kongponsrisiri. "SiamEPOS" is a registered UK trademark (UK00004385501, Classes 9 and 42).

You are granted a limited, non-exclusive, non-transferable licence to access and use the service for the duration of your subscription. This licence does not include the right to copy, modify, distribute, or create derivative works from any part of the service.

Your restaurant data (menus, customer records, orders, etc.) remains your intellectual property at all times.

11. Limitation of Liability

To the maximum extent permitted by applicable law:

Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded under English law.

12. Termination & Data Export

By you: You may cancel at any time as set out in Section 4. Your data remains accessible until your subscription ends.

By us: We may suspend or terminate your access immediately if you materially breach these Terms and (where the breach is capable of remedy) fail to remedy it within 14 days of notice. We may terminate with 30 days' notice for any other reason.

Data export: After termination you have 30 days to request an export of your data in CSV or JSON format. After 30 days we may delete your data from our servers, though data archived locally on your desktop device (SiamEPOS Pro SQLite records) remains on your machine.

The SiamEPOS Pro desktop application includes automatic nightly HMRC-compliant archiving of Z-reports and bill records to your local Documents folder, independent of cloud connectivity.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

If you are a consumer (rather than a business), you may also have rights under the law of the country where you are resident, which these Terms do not affect.

14. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you by email and update the "Last updated" date at the top of this page. We will give at least 14 days' notice of material changes.

Continued use of the service after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you may cancel your subscription before the changes take effect.
